Construction

The building must be planned, constructed and maintained in accordance with good practice.

Construction within the meaning of the Building Code is a building

  • erection,
  • establishment,
  • installation,
  • demolition and
  • other activities related to the building, whereby the building changes its physical characteristics.

A building permit or building notice is required in the cases specified in Annex 1 to the Building Code.
A permit for use or a notice of use is required in the cases specified in Annex 2 to the Building Code.

A building permit for the construction of buildings and structures is usually issued by a local authority. In special cases provided for in the Building Code, the Consumer Protection and Technical Regulatory Authority issues building permits.

Competence of the Consumer Protection and Technical Regulatory Authority in the issuing of building and use permits

  • If the application for a building permit / use permit includes buildings on the basis of a special development plan, the building permit / use permit is usually issued by the Authority.
  • If the building project submitted with the application for a building permit / use permit includes buildings for which the granting of a building permit / use permit falls within the competence of the state and local government, the Authority generally issues the building permit / use permit.
  • If the building project submitted with the application for a building permit / use permit includes buildings for which the granting of a building permit falls within the competence of several state authorities, the authority usually issues the building permit / use permit.
  • Companies must submit a building permit or construction permit to the Consumer Protection and Technical Regulatory Authority in order to establish a National Defense and Security Authority and infrastructure at the State Borders. No building permit or construction permit is required for the construction of a National Defense Road. It is not necessary to submit a building permit or apply for a permit to build the National Defense and Security Authority and the State Border Infrastructure.
  • Conditions of construction as well as building and operating permits for railway installations are issued and the Authority issues construction and operating declarations.

A company operating in the construction sector must inform of its economic activity and be competent to carry out the work professionally.

In the construction sector, a company and a competent person can provide their services and engage in economic activities if the qualification of a competent person acting under the responsibility and for the benefit of the company is proven by a professional qualification based on training and professional experience.

The competence of the company corresponds to the qualifications of the persons acting under its responsibility and on its behalf.
