Execution of decisions

Traders who do not comply with the Commission's decision will be informed to the public so that other consumers can take it into account in future transactions. The trader has 30 days to comply with the decision of the Consumer Disputes Committee. If the trader fails to comply with the decision within 30 days, it shall be entered in the list of non-compliant traders (the blacklist) until the decision is complied with, but for no longer than 12 months

Execution of the decision is not compulsory, and enforcement proceedings for the execution of the decision by a bailiff cannot be initiated. Thus, in a situation where the parties disagree in principle and the trader does not comply with the decision, the solution is court proceedings, which, if successful, will result in a decision to be enforced in the course of enforcement proceedings (with the help of a bailiff).

Disputing a decision of the Consumer Disputes Committee. If you are not satisfied with the decision made in your case, the dispute can only be resumed in court. The decisions of the Consumer Disputes Committee shall not be reviewed or amended by the chairpersons of the committee or the Consumer Protection and Technical Regulatory Authority. The procedure of the Consumer Disputes Committee ends with a decision and is not reopened even if the parties submit new allegations, new evidence emerges or if a party wishes to dispute it otherwise. In this event, the case must be brought before a court.

If both parties do not agree with the decision, they can apply to the county court to resolve the same dispute. It should be borne in mind that court proceedings may involve additional costs for both parties. It is therefore particularly important to provide all the necessary evidence and justification already during the proceedings, as it is not possible to amend or supplement the decision at a later stage, but the dispute must be reopened in court.
