The regulation of insolvency protection provided in Directive (EU) 2015/2302 on package travel and linked travel arrangements have been established in the Tourism Act.
Acting as a tour operator and a undertaking facilitating the conclusion of contracts onlinked travel arrangements requires submission of a notice to the register of economic activities and possession of a proper security.
The travel retailer has no obligation to submit a notice of economic activities and provide a security, unless the travel retailer offers and sells packages combined by a travel undertaking of a state outside the European Economic Area. In this case, the travel retailer is considered as a tour operator and should comply with the requirements for such an activity in the form of submitting a a notice of economic activities and providing a proper security.
